6 doughnuts: not taxable. Lettuce plants: taxable

I was at the garden centre yesterday and after finding lots of edible plants for my new garden venture, I went to the cashier. I asked if the herbs and vegetable plants were taxable and was told yes (even though they are edible, and I may add, healthful). At the point, a fella standing behind me made the observation that there is something very wrong with our tax system when:
1 doughnut (high in fat, sugar and salt) is taxable
6 doughnuts (ditto) are NOT taxable
